I have decided to add you to my deviant watch just to piss off all these
self righteous commenters who think
they do the world a great justice by
spamming you with holier than thou
hate speeches of "Fan Art belongs to the person who drew it" No! It belongs to the person who created the character.
If you draw batman fan art you CANNOT legally sell that fan art of batman.
You have to create your own characters
for you to retain any rights to it.

It's just like with AMVs. Someone will
make a cool AMV (which is even more so
a legal gray because they use actual
material from the anime) and it will be
cool and then someone else will like
it and upload it and people cry "THIEF!"
when neither the clips nor the music
belonged to the person who made the amv.

As long as you don't sell the fan art
you're cool in my book.

Fan art does belong to the artist - hence why it is called fan art. The character belongs to the creator. For instance: You cannot come to my page, pick a fanart I did and repost it on your page. That is in fact theft.

This is an art site, not a site to post images you like that you did not draw. If you like an image, you add it to favs.

By your statement, you promote art-theft, as minute as you may think it is. As an artist, you should know better.

So then if I drew a scribble of Naruto without even really trying and someone else uploaded it to their account it wouldn't
really matter because I didn't put forth effort and therefore
in that case it would be ok if someone "stole" it?

Seriously you people, quit bringing up "the work is beautiful"
and "so much effort was put into it" and all that hoopla. It has
very little to do with uploading a fan art done by someone else.

What about the manga pages he uploaded? What about the art and effort in THAT? Why does nobody complain about that when that
is pretty much copyright infringement right there.

Viz doesn't complain because it's not affecting their sales.
If DivingPhoenix started selling any Naruto related stuff
not only would he get kicked off deviant art he'd probably
get sued too. But since it doesn't appear DP is doing that
then he doesn't really have to much to worry about.

You know you all talk about Lili being victimized but really
he's actually helping her out because for those who didn't
see Lili's work on Lili's web site or whatever we see it here
and since he says all Lili's drawings are not his but Lili's
we know that pretty much everything was done by a person
named Lili.

This isn't any worse than a Garfield website that has Garfield comics. If you're gonna act like the Caped Crusader why don't
you look for all the non-official websites that have Garfield
comics on it and tell what's happening to the publishers.
Then again...they already know what's going on and allow it to
continue because the websites although illegal help them.

You could try doing that. However pretty much ANYBODY could
take my comic and say it's there's. I wouldn't be surprised
if somebody has already. If you want to post of my comic
go right ahead. You have my permission. People will know
eventually that it's not yours because you won't be able
to produce more like it. I however can produce more of it.

Same thing with DP. He can post as many Lili pictures
as possible but he won't be able to create a new image
in Lili's style.

In any case posting my art/graphic novel WOULD be flat out
copyright infringement since I own the rights to it.
Lili does NOT own the rights to FAN art of Naruto.
Masashi Kishimoto owns all rights.

Eh it's what she asked. I doubt she cares about someone privately sending someone else a picture and crediting her. She just doesn't want her stuff being publicly posted.

Sometimes it bugs me, too, because she is so talented, but it's what she asked for and I feel we should respect that. There are lots of Japanese fanartists who say not to redistribute their art without crediting, and others like Lily who say don't redistribute at all. If I know the artist's website or even just their name, I try to keep with that.

It also just goes against the dA rules, because he's posting stuff that isn't his.

The FAQs talk about taking copyrighted work not fan art.
Since Lili (the person who drew the fan art) can not be the
owner of the fan art the policy doesn't necessarily apply.

It's more of a moral issue that he has Lili's work on his profile and you can decide for yourself about that.

Garfield websites are NOT OKed by the author Jim Davis.
Not officially at least. However Jim Davis will allow people
to get away with using his comic if it helps to boost profit.
After all when you think about it, it's good advertising.

Bickering to me or DP won't do you much good. So instead you
should be bickering to DA. If they don't respond then bicker
again to them. Even if I was bothered I couldn't do anything
about it. If you already issued a formal complaint to DA
then either write again or just be patient and wait.

Show me where it actually says you can't take someone else's fan art. From what I read you can't take someone else's copyrighted material. Material is copyrighted as soon as it is created however it has to be your own work and can't be derivative. Fan art is derivative from the original work.

I'm talking about websites that would scan a garfield comic
and upload it online without the author's permission. There
used to be a ton and I'm sure if you search you can find one.
I think you meant Garfield minus Garfield and anywho I wasn't
talking about that. If that's gotten Jim Davis' thumbs up
of approval then more power to them. I'm talking about websites that take Garfield or any other comic. If you read
manga there are sites like NarutoFan.com that upload
scanlated Narto comics and are of course illegal.
However Viz Media despite knowing what's going on will allow
these sites to continue if the sites help to increase profit
for the comic and also if going after these sites will do
more harm for themselves than good.

Anywho like I said you are just wasting your time talking to me. The time you spent wasting talking to me you can spend
more time gathering others to rebel against DivingPhoenix.

There are tons of ways you could better use your time but
you don't because you'd rather try and win an argument than
actually solving a problem.

Yes I'm arguing with you two but then again I'm not the one
pretending to be the caped crusader and defender of justice.

unless I have a reason to do so.

No wait...I have. My own comic. I didn't draw it. But I paid someone to draw it. The drawings belong to the artist but
the idea and story belongs to me. However this is a different situation altogether.

DivingPhoenix wanted others to see Lili's artwork and to increase exposure. Otherwise he wouldn't have credited her.

Yes dA probably WILL remove it. They'll remove it because
people reported it. Just like on youtube people will report
a video that has nothing wrong with it just cause they
disagree and the video gets taken down.

You can't upload someone else's art period.

Then that would mean fan art isn't allowed because fan art
does NOT belong to the person who drew it. No matter how
different the style as long as the intent is there that
people recognize it as being from this or that.

So if anything the problem is that DP is uploading Masashi Kishimoto's art work and doing so without permission.
