Hi TeflonDjinn,

Thank you for your question.
Victor and I had a discussion on the issue in May of 2013 when he posted notes to the moderator as well as the members of a very small googlegroup called Alluring Illusions.
He wrote: "I will be reporting Alluring Illusions to Google for copyright infringement, although just removing my material may not stop legal action against individuals at this point"
In the wake of his threat the intimidated moderator asked us not to post new colourings of Victor's drawings. The group still exists without any new activity since then and no legal action was taken. A secret group was organized that continued to colour and share his drawings.
As you may note from headlesshobbs' comment below, he solicited money from several people over a 2-3 year period at his Patreon site for access to view his new and previously unposted coloured drawings and a short while ago pulled all that content offline, robbing his 'patrons' of the product that they had paid for. He is not a victim. He has a history of this sort of abuse of fans and patrons and they have 0 legal recourse in these matters.
I and his other early fans are aware that he is very angry and upset about our colourisations of his drawings. However, based on the fact that our colourings have not had a substantial effect on Victor's art business we have done nothing illegal or against Canadian copyright law and do not legally need his permission to colour his art and post it as we have done. People who want to own his original art will continue to buy his original art. Those people are not going to make buying decisions based on the availability of our amateur colourings.
The following citation can be found at its updated link: laws-lois.justice.gc.ca/eng/ac…

Non-commercial User-generated Content

Β

29.21 (1) It is not an infringement of copyright for an individual to use an existing work or other subject-matter or copy of one, which has been published or otherwise made available to the public, in the creation of a new work or other subject-matter in which copyright subsists and for the individual β€” or, with the individual’s authorization, a member of their household β€” to use the new work or other subject-matter or to authorize an intermediary to disseminate it, if

(a) the use of, or the authorization to disseminate, the new work or other subject-matter is done solely for non-commercial purposes;

(b) the source β€” and, if given in the source, the name of the author, performer, maker or broadcaster β€” of the existing work or other subject-matter or copy of it are mentioned, if it is reasonable in the circumstances to do so;

(c) the individual had reasonable grounds to believe that the existing work or other subject-matter or copy of it, as the case may be, was not infringing copyright; and

(d) the use of, or the authorization to disseminate, the new work or other subject-matter does not have a substantial adverse effect, financial or otherwise, on the exploitation or potential exploitation of the existing work or other subject-matter β€” or copy of it β€” or on an existing or potential market for it, including that the new work or other subject-matter is not a substitute for the existing one.
-----------

So despite Victor's protestations to the contrary, his permission is not legally required. This is not an issue of what is or is not in the public domain.
On the other hand, as I have stated here before; everyone who comes to this site is free to choose based on their personal morals to look at and download any of these colourized Rinaldi drawings or to not do so.
You can also view below his note to me in 2011 telling me that my coloring work was "nicely done".
In my opinion he would like to "close the stable door after the horses already ran away." I still have more than a hundred of his earlier uncoloured drawings that were posted on the internet with his knowledge and either his active or passive permission which I will be colouring in my spare time with the intention of posting here.
I completely understand if you choose to support his stance by removing your presence from this site, but if you enjoy seeing these coloured drawings I would like to encourage you to exercise your freedom by continuing to browse this gallery.
Best wishes,
Paul

Quick question: Do you have permission to recolor and post Rinaldi's art?

πŸ‘: 0 ⏩: 0

headlesshobbs [2016-12-31 18:44:46 +0000 UTC]

Vic's Patreon account:

= +2 years of posting content
= $9-16 per month at $1 each (plus free bonuses)
= Pulled content offline without so much as an explanation to anyone who's paid for the right to view such content.

Also like to make the statement that I was blocked from commenting by him on his Deviantart page for questioning him about it.Β  If you're going to treat your supporters like $h*t, expect to get treated like $h*t in return.Β  We love your art, but you sure as hell need to figure out what your problem is.

P.S.Β  Don't think for one second that you have the right to blame me, I'm just a supporter.

Sorry to hear about your losses. If you previously downloaded any of the pics that were pulled perhaps you could share them on one of the groups devoted to these kinds of drawings. I'm sure there are dozens of folks who would like to see what he's been up to for the last couple of years.

headlesshobbs In reply to tsava592 [2017-01-01 02:42:26 +0000 UTC]

As much as I'd love to share, I'm not entitled to do so for reasons that are pretty obvious.Β  (I'm quite honorable to artists and their works)Β  Vic still has to explain himself to the near 70 members he had on his account at the time he was still sharing his works with.

Someone did release all of his Patreon works after the fact, so I guess in a way that's karma for ya.

tsava592 In reply to headlesshobbs [2017-01-01 03:29:00 +0000 UTC]

That's fine, in fact it's great. I appreciate you sticking by your principles.
Sorry again about what happened to you, especially since you supported him as a patron. It's a shame you and his other supporters aren't receiving the loyalty from him that you've earned. That has unfortunately been a pattern that he's followed with his supporters in the past. He abandoned his own website and the webmaster who was operating it for him with his usual self-serving rationalisations a few years ago. He made a lot of enemies with that move. I've only ever wanted to be his friend, but he's proven very neurotic and narcissistic. Hopefully someday he will grow into a mature person who sees and cares about other people besides himself.
Anyway, since you're not responsible for the release would you be willing to tell me where that other person released those works?
Thanks for your comments and etc...
PH

I wish I knew the link, sorry.

But yeah, it's as I said that he really has to learn what his problems are.Β  I've seen how many artists operate across the net for a number of years and so far Vic is the only one that's been so self centered about his art.Β  A "I'm going home and taking my ball with me" type.Β  I've seen that site some years back and it left me scratching my head over whether or not he's into it for the community or if he's in it for himself.

I'm glad I can speak here at least as he won't let me under any place that he's got direct control over.Β  This has been one thing that I've been keeping to myself for a long time and ever since I've seen him making a fuss about your page on his end, I just had to speak up and let everyone know that this $h*t has to stop.Β  Vic has earned his reputation, now it's his turn to "deal with it" by growing up.

I don't see anyone else pulling an act like this unless they've something shady.

Here's a note I got from the original artist, Victor Rinaldi in March of 2011:
----------
Rinaldi-Pin-Up said the following:

Hi Paul,
Β I just recently saw your coloring work, nicely done… I liked Buffy’s colors as well, I do think we have very different styles; she applies a type of blurring filter to the drawing that blends the graphite texturing which gives the finished colors a soft airbrushed look, I think it’s interesting and certainly looks very fanciful but I feel it can at times hinder the art by obscuring the often wonderful textures that the graphite creates.
Β Oh, and as far as I’m concerned; there are no politics… for there to be politics there’d have to be a quotient other than myself and as far as I know, none exist.

Victor

Thanks again to Victor for the old compliment.

The original drawings were done by a real artist who continues to create new work. These are older pieces that have been available on different sites for several years. I and several other fine colorists have been working on these for quite a long time.
My work has included coloringΒ many pieces from grayscale versions, modifying other colorists work, and adding background to drawings that lacked original drawn backgrounds.

tsava592 In reply to ArtOfPhranger [2016-11-22 02:44:59 +0000 UTC]

I don't take credit for the drawings or even all of the colourings, though I have modified most of them over several years. However all a person needs to do is Google Victor Rinaldi drawings and they can find them in several places where they have been available for years. Victor intentionally posted many of them, and mostly in greyscale without colour, himself for a few years. They were continually posted on his own website and re-posted variously in Yahoo and Google groups in greyscale and coloured versions until he had a change of heart.
Artists can be quite sensitive and tempermental, and it's a shame that Victor's feelings are hurt, but these legal modifications are free and just for fun so everyone is able to choose whether or not to view them based on their own ethics. I'm not profiting from them in any way other than the enjoyment I get from colouring them and sharing the coloured versions with other people who enjoy viewing them or downloading them for their own private use.
