Description In 1932, cartoonist Frank Foster created a character named Batman. He was ver similar to the DC comics' caped crusader that we know, which was officially created in 1939 by Bob Kane and Bill Finger. Would be Batman a case of plagiarism?

I like your cartoon version.
Read the site, very interesting. I don't think Bob Kane copied it, much less Marv Wolfman made Nightwing of that either.

Thanks!
Considering the amount of coincidences, I still think that he did, but it's something that no one can prove after so much time.
It's easy associating the idea of a night vigilante with names like Batman and Nightwing. Most superheroes at that time used to wear masks or cowls. And it's important to think that the first sketches of batman by bob kane were very different of frank foster's. So, yeah, it could have happened that they had the same idea separately. But, in my opinion, plagiarism is more probable.

I suppose so, in those days was more common and there weren't any of the © or TMs laws that exists today.
As for Nightwing long before Marv Woflman made Dick Grayosn grow up and give up his Robin self; there were two heroes that appeared in the pages of Suerman Family and other Superman related books, called Nightwing and Flamebird, they were citizens of the bottled city of Kandor, from where Wolfman said he took the idea.
