I think if she was more like this an WAAAYY more calm then I might actually find her likeable! I know she tries to make Ciel happy and shit but I just really don't like her over all character.

Believe it or not, pictures you DID draw are technically not allowed. Apparantly you have to have the original creator's consent to even do a fanart. That means if you want to draw (and yes DRAW) a picture of Sebastian, you are supposed to have a written statement from the creator. That means DA is an illegal site.

Actually, with DA, that's not the case. I can't find any rules stating that fan art itself is against the rules. If there is such, please make sure to show me otherwise. Of course, with things like picture by others, there's specific rules stating they're not allowed

Not in DA, this is federal law. DA itself is breaking the law by allowing fanart without the creator's permission. This applies to fanfiction as well. There are circumstances for "Fair Use" but then, there are also circumstances for Fair Use in parody posters as well so that arguement can't be used. [link]

Hm, good argument. Though, with fan art, there are loop holes as well. Like the fact that, with most companies, as long as you're not making a profit off their work, they don't mind it. Also there's the fact that if you do alter the fan art, it's more likely to be protected than if you just copy the style fully.
Now, if those points are wrong, and you know for sure they are wrong, please let me know. I used multiple sources, but I want to make sure that the information I use is not misinformation.

I agree with your argument, and I see your reasoning. However, I have made a few demotivational posters myself, and write fanfiction, like thousands of others. I do it not to infringe on other people's work, but to provide entertainment for others. And I ALWAYS give credit to the original owner. Even so, I feel that even if we were to try to sort out the copyright situation, it would me on too massive a scale, so let's leave it be, methinks.
