hey there, I didn't know you were the original artist of this picture that i found on photobucket - s1087.photobucket.com/user/xBl… and i had made a base of it. I was just linked to your picture a few hours ago. If you want me to take down the base I'll understand ^^ just wanted to clear it by you now that i knew you were the original maker

The damage has been done. I am notifying the Photobucket user that they must link to the original image or I will notify Photobucket of the copyright violation.
As for your base, please credit me by linking back to here and name me in the description (IE, Deep Creature by DeviantHomunculi).
For future reference, please check with the artist before making a base. It was pretty clear by the Photobucket users account that it was not their art, and just leaving the names and urls doesn't mean it is not theft. I would have gladly allowed you to make a base from any of my artworks if I had known in advance, so long as you had linked back to each of my works. Please keep artist consent in the forefront of your mind when you are making bases from someone else's work.

As I said earlier I didn't know it was your art, if I knew it was yours or found it on da I would have asked you, but I didnt, so I linked it to the only picture I had. I didnt look at the rest of there profile because I saw that picture in a search not by looking through there account. Ill credit you when I'm home, right now not

It's still best for everyone involved to ask permission first before making a base. The Photobucket user may have told you it wasn't theirs and given you the proper source link (unlikely, as they haven't responded to me yet, but it could have happened).
And it's about respecting artists who put time and effort into their work, and that you made a base from someone's art and didn't try to contact the surprisingly readable urls (considering the low-quality copy the Photobucket user uploaded) at the bottom of the image, which are completely dissimilar to the Photobucket users name. Image searching is easy and accessible on many different sites, including Google, so you could have used that if you had thought of it. And you said you didn't look at the Photobucket users gallery but it's pretty unthinkable that an artist would use Photobucket and not put something in the description (date finished/time taken/etc).
There were lots of clues that it was reposted work. And the fact you ignored my very readable DeviantArt url on the bottom of the image honestly makes me extremely angry. There is no reason for you to claim you didn't know it was mine when the url was right there, and you could have contacted me about it for confirmation. The only reason I'm not asking you to take down the base is because the damage has been done. I don't know if I would have wanted you, or allowed you, to make a base from my art, but now I've had the choice taken from me. It is a far worse feeling than you can imagine.
So, ask before making a base from someone elses work. Bases, which is tracing, do not remove copyright, so it's a bad idea to leave yourself open to be hit with copyright violations. And it's been a day since your last comment, so please put the proper source url and remove the Photobucket users url as soon as possible.

i had asked the person through a private message, they said yes, they said nothing about it belonging to anyone else. i contacted you because i wanted to make sure i could keep the base up and make up for the fact that i didn't KNOW it was yours. if i had known it belonged to anyone else i would have asked them, but i didn't. and no you haven't had the choice taken from you, i can take down the base. and i do know the feeling, i make my own pictures on another account as well and they've been stolen before and i didn't ignore the deviantart url it was to blurry to even see. i contacted you to make up for what happened, not to get yelled at. I'm not the one who stole your picture and put it up on another website. If you'd rather have me just take the down base then fine i will, but id rather not have you getting angry at me when this isn't really my fault.

I apologize for the assumption that you didn't contact anyone, but both of the urls were quite easily read from the three different computers I viewed it on, as I checked due to being confused as to why you would say that. It may have been a lower-res copy of my image, but clicking the 'zoom' button made it a small issue. My issue with it being on Photobucket (aside from obviously not being my personal Photobucket account) is that it was clearly shrunk from the original image size, possibly in an attempt to make the text harder to read, but not succeeding. That made it very pretty clear that the theft was intentional but they wanted to try and avoid being hit with a violation by leaving semi-readable text, but they didn't plan it right and left it too readable.
I'm sorry if my anger in my previous message seemed vehement, but while I can understand being excited to work on something, it could have been easily avoided by zooming in on the picture to read the reasonably clear urls. I am, however, dropping this part of the conversation here and now, since the Photobucket user has deleted my image from their gallery instead of crediting, and we cannot consult the stolen image anymore, making further discussion worthless.
And yes, my choice was taken away. Sure you're able to remove it now, but I never was given the option in the first place. I probably would have been hesitant but okay with the whole thing if I'd been contacted initially. You may keep the base you made up, since people have used it, but refrain from using any of my other works, at least until I sort this all out.
The only other thing I have to say is a suggestion, and that is to completely avoid Photobucket when looking for something to make a base off of. There is essentially no chance that any artwork you find there belongs to the user, and as such it's not possible to get permission. You may find photographers there, but artists are so small in number there, that they are barely worth mentioning. DeviantArt, Wysp, and SheezyArt will give you near-perfect source material, and Tumblr is fairly good at keeping/maintaining/adding sources. They are far more reliable than Photobucket, and you'll be able to avoid accidentally getting embroiled in this sort of brouhaha again.

Yeah I don't use photobucket anymore, that was the first base I ever made. I don't go on the website anymore. This is the first one of my bases I've had an issue with

Thank you again! I notified the Photobucket user that they didn't have to remove it if they credited me and linked back here, but if they do not I will notify Photobucket of the copyright violation.
Thank you so VERY much for looking out for me, and artists rights. This isn't the first time I've dealt with art theft, but this IS the first time someone was there to notify and help me. It means more to me than you may realize.

Ah, I hate art theives, but i noticed your siggy on the orginal image, and i was like "Oh no!"
I know most traced bases are bad, i tend to avoid them, but when i see bases made from actual art from here i notify them ASAP so the base maker and the original artist art informed! C:
