Well so long as A.It's not a webshop or a site 'selling' anything for profit., B.the image can't be right clicked and saved by other people(ie you're not just redistributing the tile itself), or C. it's a site like Deviantart where using an image kind of claims you made it
using it as a BG image on a personal blog or something is fine

it's just a tile, but you can always make a custom box bg out of it by tiling the image in a larger one in photoshop or gimp etc
