I haven't seen the rest of your work, but the photographer did a good job with the limited lighting and capturing your pose with the angle and composition. I think it's art because you're the model- a lot of photographers get on here, touting to be artists, taking credit simply because the model is beautiful and shinning a flashlight up her nose and snapping a picture would still make her look great -as is the case with you apparently- you're going to take good pictures even if the photographer is lousy.
So where your work comes out as an artist and for being challenged, is in posing and setting up lighting and how you look and the environment.
Here, you make the chair look comfortable and even sensual but on closer inspection, that looks like one horribly uncomfortable place to sit for long.

In real life it is also a rich guy, but rich in attitudes and feelings ^ ^
