Hey, i souped this up a while ago.I did an image search (and yes this is kind of copying) and found a horribly low detail jpeg; and "redid" the image not using one piece of the original image as poart of the new one that I am showing you.

No actually, i made a custom selection of the image and made it a vector shap in photoshop, and the image was such low detail that the corners got rounded, but i kept it that way, it looked nicer, and the image posted must have somehow losted alot of detail gecause had none of the multicolored spots.

umm... you very much copyrighted the design... down the colors
this would be considered original if you altered it somehow... or added a vector of Billie Joe or something, but this is very much copyright infringement.
