and so it is a dilemma... is this photo simply yours because you pressed the shutter release on my camera OR - is it actually Dana's because it was originally his idea.???

I think this photo belongs to the whole band + you.

You can own the bit with you in it, ben can own the bit with him in it, steve can own the bit with him in it, and ollie can own the bit with him in it. I can own the background, and Dana can own the concept.
