This could happen. I seem to remember hearing that Nintendo got permission from both Rare and Microsoft to use Banjo-Kazooie in Super Smash Bros. 4 and even add in a battle stage based off of one of the Banjo-Kazooie Games! Β

Well Nintendo owns the original copy rights for these two. Microsoft only owns the darker colored versions from "Nuts 'n' Bolts". Each company owns a portion.
In other words, Nintendo could add them in without copyright infringement.

Except what you have said is completely false, Nintendo doesn't own anything about these two - Nintendo sold Rare and ALL the rights to Rare IPs (Donkey Kong wasn't a Rare IP) to Microsoft - which includes ALL of the rights to Banjo-Kazooie, Conker, Perfect Dark, Sabreman, Battletoads, etc.

Nintendo never had rights to Banjo-Kazooie, Rareware did - and Rare still does, under Microsoft now.

They can still technically get in, but Microsoft Game Studios and Rare have to both be mentioned in the credits - and Nintendo needs Microsoft's permission for any design of Banjo-Kazooie - old or new. Hence why Banjo-Kazooie and Conker were removed for the DS port of Diddy Kong Racing, Nintendo only had permission to use the side characters from DKR (Tiptup, that watch guy, Wizpig etc.) because Nintendo owned those characters.

They still have enough leverage though. Microsoft may be a big company but Nintendo is larger by far. It wouldn't take much for them to get those two. I've put in two votes. One for Bomberman and the other for these two. I may even put one in for Shantae. I love Nintendo 64 and GameCube games as well as all the handhelds. The games are getting easier though, especially Mario, and I don't like it. That's why I stick to retro.
I would like to challenge you to a match but the circle pad on my 3ds is almost falling off. I have to push it in constantly... It reminds me of SSB when the winner was the person with the best controller.

Of course, although Microsoft as a whole company is probably bigger but on just the Gaming side Nintendo is definitely bigger. Considering the Head of X-Box supports their inclusion there aren't too many legal and permission problems in the way. Really if there is enough demand it cold happen, assuming it doesn't get vetoed by Nintendo due to it being a move that would help their competition too.

I actually remember a few years ago at a sleepover, we were playing Brawl, and I decided to use the broken Gamecube controller to level the playing field as it was my copy of Brawl that I'd had for years (Thus I was more experienced), and still won like half the time. The control stick would occasionally bug out and always input left, and the a button was pressed in really far and I could barely press it - meaning I had to stick to Smash attacks and Specials. It wasn't an official controller, although one of my official controllers broke too - so a very kind friend of mine bought two replacements for me.

Couldn't help but notice this conversation, and it kind of piqued my interest a bit.

It might seem like a small, minutely trivial detail but...I started playing Banjo-Kazooie for the first time in over 13 or so years albeit the XBox 360 version via Rare Replay and couldn't help but notice something.Β  This screenshot: static.gamesradar.com/images/m… That image was taken from the Nintendo 64 version, but interestingly enough...the same scene can be found in the XBox 360 version of the game as well.Β  And it was even ported over into Rare Replay.Β 

Banjo is holding a Game Boy in his hands.Β  Not just some generic game system created by Rare for Banjo to hold, but the Game Boy.Β  Something that is an iconic part of Nintendo's legacy and culture.Β  Something that is created by Nintendo, and Nintendo themselves holds the rights to.Β  No doubt about it, it's Nintendo's trademarked and patented signature Game Boy in every way.Β  It makes me wonder how in the world a port of a game that made every attempt to scrub Nintendo's previous imagery associations off the surface of it (like here: www.mundorare.com/imgs/content… ) would just off and leave Nintendo's very own Game Boy in there.Β  If they could modify the xylophone, they surely could have at least made the Game Boy look a lot more generic in nature somehow to make it more like a generic handheld system.

It might not seem like a big deal, but if Nintendo's own Game Boy can still appear in there no matter how small its appearance...I can't help but wonder why then can't Banjo and Kazooie appear in Smash 4.Β

I think the write-washing was of mainly things that literally said Nintendo's name - so the Xylophone and the opening honky-tonk N logo. But as for the Game Boy, it may have been seen as just generic enough not to immediately shout Nintendo into people's faces - it doesn't have any Nintendo labelling even if it is obviously the Game Boy. In any case it is probably an oversight by the developer - due to not saying Nintendo on it - or not seen as enough of an indicator of Nintendo to be considered to be changed.

Also, Microsoft and Nintendo do not directly compete in the hand-held market, so Microsoft may have seen it as OK to allow a Nintendo hand-held to be displayed becasue there is no XBox hand-held for it to be a competitor to (Even if the handheld in question was already being retired when the original game came out a decade and a half ago - let alone when the port came along only a few years ago.)

That is possible, though as you said it is unmistakably the Game Boy itself. Nintendo has added cameos of its own systems in their own games like PokΓ©mon courtesy of Game Freak but never had the logo itself visible on the front at least as far as I can recall.

Also, that second part of your statement certainly does intrigue me. I didn't think of it like that, even if I already knew a prime example was like letting Rare develop the DKR port for the DS. Although, I still think it only seems fitting to at least give some consideration to B-K being in Smash if we point back to that Gameboy cameo in the 360 port. Given Rare removed their signature characters from the DS port since Nintendo no longer owned them, they should have removed Nintendo's Game Boy from BK's 360 port as well.

I certainly understand that just by the GB's leftover inclusion alone probably isn't wholly solid proof to as why they should allow Banjo in Smash...but it is an interesting and curious topic to me nonetheless. I know Phil Spencer was okay with it...but even so, it'd probably be more up to Rare themselves and the rest of Microsoft...and Nintendo would probably be even more of a holdout given how strict they'd be with who could be included.

...But if we point again to your statement about Microsoft not competing in the handheld market...do you think it would be feasible to include Banjo and Kazooie in Smash but maybe only exclusive to the 3DS version? As we already know Nintendo seems to have no problem with making things exclusive given Mewtwo was originally planned as a Club Nintendo exclusive before being globally released instead and Nintendo sure does love North American retailer-exclusive amiibo.

Just a thought though. :0

I don't think the Game Boy is really much of an indicator of anything in the slightest in reagards to Nintendo and Microsoft's relationship with Rare games, but IΒ  want to pull up on your idea of exclusivity.

Nintendo itself, as a corporation, might've wanted console exclusives - but Sakurai absolutely reviles it. Sakurai removed the Ice Climbers because they didn't work on the 3DS and he removed the character transformations because they didn't work on 3DS. His vision is to have roster parity, the same character rosters, on both consoles, and he is almost always steadfast and very stubborn in anything he sets his mind on.

Also about the Mewtwo release, there has been no official word as to whether Mewtwo was ever going to be an exclusive and I highly doubt that him being exclusive was ever on the cards; he was almost certainly merely planned as an early free reward for getting both games - not an exclusive one - and that he was also additionally a parting gift to Club Nintendo users as they closed (and still closing) the service down through this year.

Sakurai isn't one to want to exclude any of his fans. The rest of Nintendo? Not so much...

True, the Ice Climbers did come to mind when I thought of it as I was writing about exclusitivity. There may be people who are going to suggest the Ice Climbers be added as a Smash Ballot choice but as individual characters with a costume swap (like Olimar or Bowser Jr. or Robin) even though I can't honestly see them being a popular choice. Although highly unlikely, it wouldn't be an entire stretch to say it's impossible given Charizard broke off from the Brawl PokΓ©mon Trainer to become his own fighter slot.

Well...in some way, Mewtwo was originally planned to be an exclusive of some sort. He was originally going to be a cross-buy exclusive according to Sakurai: www.gamnesia.com/news/mewtwo-w… but ultimately they decided it wasn't the best idea. Although in this case it isn't the same type of exclusitivity that we were talking about here so I guess in a sense that bit might seem irrelevant.

I loved Roy in melee. He sucks now because he has no range at all. If you want a challenge, try and get as good as me with Peach. I'm not kidding when I say that half my friends won't play if I choose her.
I'm the Nintendo gamer in my house so needless to say, if I found a SSBM tournament nearby, I'd try to enter. I'd probably be better than half the people there.
In the original I only used Yoshi. In Melee it's Peach, Roy, Yoshi, Jigglypuff, and Pichu. In Brawl, Lucas, Peach, Yoshi, and Ice climbers. In the newest one, Peach, Rosalina, Roy, Yoshi, Lucas, Pac-Man, Shulk, and sometimes I'll use Lucario.

Yeah, you sound like you're a lot better than me at Smash - I'm probably what could be called a filthy casual in terms of the fact that I would never have the drive to play competitively (As in tournament competitively) and I would probably be terrible at it anyway. I have all but the original - I was still rather young when I played Melee and Brawl though so I didn't really main anyone - although later in Brawl I became very partial to Zero Suit Samus and Marth.

As for who I main in Smash 4 - I main the characters that I feel are the most fun to play as. At first before DLC that was the King of Evil, because lord is it satisfying when his moves connect (Once they actually connect, which takes forever and a half unfortunately). Then I played Mewtwo a lot, because he is a fun character to use personally, and now I've kinda moved onto Roy and Samus. The entire time however I've had Peach as a secondary, because the turnip game is fun. I think Pac-Man looks cool to use, but I feel that I would be absolutely terrible at using him. And occasionally I'll whip out a Jigglypuff for a B-air of a time and when I need a rest from playing other characters. I'm terrible at puns...

I also only started playing For Glory recently - I had played for Fun for a while but that gets old after a while. I've made a few friends - and I've been curb-stomped by a ton of Falcons and Sonics - and the occasional Mario too.

I am only exceptional at melee but I'm still very good at the others. I've only had one consistently amazing character, Yoshi. I never use the same strategy twice. Also, I only start dodging if there is a challenge. Basically I tank everything.

Yeah, I am not what you call exceptional at anything really in regards to Smash. I mean I'm probably above average, but this is remembering that the average includes a lot of People who don't know their jump button from their shield button *coughReggieFilsAimecough* and only a small amount (relative to the total amount of people who own or have played Smash) of people who are actually considered to be good at the game.

In all honesty, I can't see these two getting into Smash anytime now due to obvious reasons stated before; I could see Yooka and Laylee getting in instead, but some people are not keen on seeing them in Smash for the following reasons:
1. They are indie characters, which nulls their chances for getting in because it unofficially dictates that indie characters have no legacy with Nintendo regardless of familiar faces (who have or had connections with Nintendo at some point in time) in the development team of said indie game.
2. It may be too early for them to appear in Smash since we have little to no idea about their moveset and/or their game isn't out yet, despite Roy appearing in Melee under the same conditions.Β 
3. They insist that the original duo should appear regardless since they "fit in more" than the other duo (really?).
Despite these reasons, I am still hoping for Yooka and Laylee making an "early" appearance in Smash unless the Smash team has yet another Mario clone with the "dynamic duo" gimmick in mind...
