No it's not fair use actually this is someone's artwork it is in no way free or fair for him to use. The artist herself is on DA and I highly doubt she'd want some sick twisted asshole using her work for shit like this. I don't know what rules your reading but it isn't legal for someone to use another person's art this way whether they credit or not doesn't matter.

Just because it's online does not mean it's free or fair use. When artists make artwork the copyrights of that image automatically belong to them, be it fan art of existing characters or original content. deviantART may have stock photos on their website, but everything here isn't free or fair use stock use
