Max didn't kill him! It was his Skrull replacement! Having failed to successfully take over Earth-616, the Skrull decided to seek out an Earth that would not be expecting them. Max Lord was only the first of many to be replaced -- many including Roy and Lian Harper, Oliver Queen, Dick Grayson, and many more I'm sure.
