Hello zanui / Nekohimekagepuma 'or' Trolls / cyberbullies - which is what you truly are... 

     Who are you anyway ? A self appointed dA Sheriff ? And who the hell are you to assume I don't have permission ? And what's with the (zerochan is never a proper source for artwork) business ? This is not an edit, an edit is to change or modify an image, document, etc... This is a render, a cut out and saved in png format to save transparency. I however, when applicable by law get permission. In the case of this render, I got permission, I know the artist from my old pixiv account which is long time closed and never had uploads, also had the artist as friend on facebook. The zerochan link is the credit link they requested me to use. If you bother looking at the link provided you may notice the pixiv id beneath pic and the zerochan account link above it which in turn leads you to the account that uploaded the pic you provided link too. Seeing how the artist has not been online in 3 years via pixiv, zerochan or facebook what prompted you to run up all mouthy and bossy ? And furthermore I am never online anymore working days as an Electrical Apprentice and part-time nights and weekends at a local digital art company therefore I really wonder why you chose to troll me on my birthday ? If you had any brains in your tiny skull and knew anything about laws you'd probably realize what you are doing is trolling seeing how you attacked publicly online as a pair you're in direct violation of cyberbullying laws. 

     Now lets talk laws, before running your mouth trying to bully people online as if you're online art attorneys you may want to read The Fair Use Act of 1976 and all accompanying amendments including Amendment 27 concerning online activity and then you may want to cross reference Copyright laws pertaining to imaging. Copyright infringement requires claiming ownership by copyrighting something that you do not own that is previous copyrighted and owned by another party or creating an image or likeness of an image for monetary gain without direct written permission from the copyright carrier. I give 100% props to the artist and am a fan of the artist and Kid Icarus. So who is the true owner of this image ? Nintendo owns the copyright therefore Nintendo owns the image and all likeness thereof, if the artist tried to copyright or sell the image they would be in violation of international copyright laws under the infringement clause. However they put the image up in HD with free downloads because it is fan art and they probably have the common sense to know the law. Not to mention the image was uploaded in HD as a png file which makes it perfect for use as an edit. Most artist that don't want there art edited upload as a jpg so changes degrades the image usually making it unusable. Also providing link is respect to the artist and not required by law under the Fair Use Act. Under your perspective every meme and gif uploaded online would be a legal matter. You really think a lot of these people and artist that photos or art ends up a meme want that?

     In fact, this account is listed as a hobby account. Under Fair Use Act and Copyright Laws I could upload nearly anything that I didn't hold copyright for, not required to credit and as long as I'm not trying to publicly claim it, copyright it or sell it. I've done no wrong. Yet you two came on my account trying to bully me and order me around, this is a personal account and under cyberbullying laws you did break the law harassing me and guess what, I live is USA too therefore I could make a real life legal issue about that. But... I'm not like that. Look, on a personal note, your comments make for good click bait, you both got a view from me, yay. Probably both of you would have a new watcher because I support online artists. And for example, cute DeviantID Nekohimekagepuma 'honestly, I like it and would probably fave it to my cosplay album if your attitude wasn't so bad', that photo or any other photo you upload to any site online could be subject to a meme by another and there isn't anything legal you could do about it same as anyone can video tape you or take your photo in a public setting. I have and will hold no bad feelings over this encounter but would suggest you do a little research before trolling people online. I wish you both the best of luck with your accounts, art and any other endeavors you may pursue. 

     And a little advice, don't try to make money online with your art, I recommend perfecting your art and working out a nice resume and try to get on with a digital art firm. You would learn all the laws I had to learn for my job including the golden rule for all artist 'Never upload any original art work online anywhere without a copyright'. The ownership can be taken legally by anyone and they can copyright it, you can take the to court and win if you can prove that you own creation 100% but at most would only get 20% of the other persons monetary gain because they copyrighted it, a copyright is a license for ownership. However, if they never sold it you'd get $0. And, 'never upload any of your original work even if you have it copyrighted'. A lot harder to sale when Amendment 27 allows for it being spammed online allowing any possible use including printing a t-shirt or print for framing legally without even having to pay the artist for their 'hard work'. One last part of original argument is : Renders and rendering falls under educational use. Happy 4th to you both and the best of luck. But it would of been nicer to have a conversation under more friendlier terms.

The renders I uploaded were created in art school and only about 10% of what I did ever got uploaded so where the fuck you get super fun and fulfilling not to mention I don't nor try to make money from anything I do online.      Recap : Fan art is awesome but who really owns it ? When are letters of permission and / or contracts needed pertaining to fan art ? Let's see, video game characters, anime, comics, TV and movies are owned by the person that holds copyright. For example Link is owned by Nintendo which copyright states : Nintendo is exclusive owner, copyright holder and sole proprietor of image and likeness thereof. That's the first sentence and it means you can draw it all day if you want under the Fair Use Act of 1976 but you can never legally claim ownership of the image, copyright or sell the image. Under copyright laws Nintendo reserves the right to take any art of characters they own and monetize it however they are not required to contact, get permission nor share profits with an unsolicited artist.  

     Cyberbully laws state that it's in violation when you intentionally go to someones account to harass or intimidate them. Your first message was an attempt to intimidate me. You're not acting on any ones behalf but your own. The pic this was cut from was uploaded 5 years ago, my render was uploaded 3 years ago. Yet, 3 years later you and your friend comment on my birthday minutes apart, this actually inflates violation of the cyberbullying laws, which is a coordinated assault on another persons account. Maybe you should continue trolling me and upgrade it to cyberterrorism. My long response was only conversation and sharing facts with you, I was bored and hadn't been off work on Saturday in over a year. But really get a life, why aren't you on Facebook harassing the well over 10,000 people downloading thousands of art pieces and uploading to their page never giving anyone credit other than themselves. Or maybe the well over 10,000 free wallpaper sites that never credit artist or how about the subscription wallpaper sites that not only make money off of other peoples work. Oh you can't, they are protected by Fair Use Act under critique and can make money off of it listing money made as data storage / maintenance charges. In fact on dA alone there are well over a 100 accounts that have loads of photos / art they do not own.

     You don't know me and know nothing about me... I don't download art and spam it across the internet like many do. I download an occasional pic for a Facebook cover but always include artist link and in all honesty that's free advertisement. Otherwise I always share art by link through share to Facebook apps. I don't have to answer you at all and don't have to argue with you, all I really needed to do is copy / paste the Fair Use Act as an answer which is what everyone online is protected by and ends any possible argument you may have. If your a minor, mommy and daddy will love the fact that all devices attached to that IP get banned from internet usage during investigation and forever once found guilty, if you are an adult you will also face criminal charges.      Let's examine what the real issue is with you. Are you butthurt over your account not having the desired views / faves you want ? I actually almost think you may have rendered the same image and need me to delete mine so you can upload yours and to avoid being called a copycat. You have no valid argument other than self interest. {rogue advice to the novice artist} DA watermark is not a copyright, be professional and create your own. This however still would not copyright anything but it does personalize it, this in turn makes it next to impossible to use in editing, impossible for another to claim and less likely spammed across the internet. When you upload any art or pic to internet, you do at your own risk, once online it is subject under the Fair Use Act. Full length songs and full length movies fall under a different category but digital images have no monetary value and when bought are done by businesses / firms for use in advertisement / book covers / CDs / etc... in the real world, this falls under the category of real world use which gives monetary value. Face it, when an artist uploads pics to internet, it's solely for advertisement of their work, to get their name out there and popularity. It's a hit / miss chance they take. Acting like you would only work on a small scale. People downloading it and uploading it across internet via social media, etc... becomes free advertisement and is the only way to advertise the artist on a large scale, that is where the hit / miss comes because sometimes credit isn't giving. A serious investor that would allow the artist to make money for their work could find the artist regardless of credits provided by simply knowing any image they created. Copyrighted photos and images still fall under the Fair Use Act online and in the real world too. Copyright labeled crimes in art and photography only happen in real world when monetization is involved by someone selling physical prints when the copyright license is owned by another individual. Funny how it seems that only novice online wannabe artists run around playing online art cops. True artist and professional / career artist don't, you think it may be because they know how the system works ? Learn the laws, learn the economy, learn to make money with your passion. 

     In closing, your arrogant ignorance and unprofessional attitude really irritated me to wake to, I wrote a friggin' book, lol.
