Uhm sorry but I just tried to copy the theme also in /usr/share/themes and it seems your theme works fine.

this is already my favourite theme but i wish there was a version where the popup menus all were dark. i dont like some menus being dark and others light

Which popup menus are you talking about? Could you make screenshot of what you do not like?

It's just modified Ambiance theme and I think it's logical, when you open menu from dark menu bar it's dark, and when you open right-click menu in your file manager directory with light background it's light too. I see no problem with it.
