This is very similar to a picture by If you had permission to reference the pose then it's fine, but make sure you say in your description.

AAAH! I looked up this "Raniiee" just now, and I didn't know it was already done by that person! I just looked up random reference pictures on google and this one came up, but it was done by someone else and it had a different background! I didn't want to do the EXACT picture so I SLIGHTLY changed the jacket and expression a little, but I guess now it's not that much. I'm sorry! Is this illegal??

Just as long as you say you used a reference in the Artists comment, and let the original artist know and they don't mind your using their work reference it should be fine. In case of pictures you don't know who drew the original and cant find it (I know of several SasuSaku and SasuNaruko pictures of this form) just say you used another picture as a reference. Same with anime screenshots. I've done that myself when I first started drawing.

If the artist doesn't want you to keep the picture up though... That's different. Technically they don't own the characters themselves, so you wouldn't be breaking any real copyright laws by referencing their work, but it's still not really right considering the effort they've put into the work so...

It's up to you. I hope this doesn't sound like a lecture - it wasn't intended to, especially when I'm guilty of screenshot reference myself I'd advise speaking with the original artist here on DA though.
