On the lawsuit you mean? They're not going to disband. If they loose the contract with SM, they still have AXEX in Japan. But I'm happy they're suing them. SM needs it. Their contracts are too binded. If they don't reach a compromise, I'm sure other companies are willing to pick them right back up, but I doubt SM would want that, because TVXQ brings in the money XD
