Whoops. I messed up. Each item is separated by a ;. It is...
"quotation of short passages in a scholarly or technical work, for illustration or clarification of the authorβs observations;"
There are no passages.
You have taken the artist's comic panel which he has drawn! You have added color, BUT IT'S STILL THE ARTIST'S COMIC PANEL THAT HE HAS DRAWN. You have used something which you have no right to use, so are are stealing his intellectual property and his creative work.

1. Oh fuck no. Seeing colors is not educational. What are you smoking? Educational is when a certified teacher in a classroom shows it to students along with a powerpoint. The museums have obtained that artwork legally from the owner and has obtained the right to show it at their establishment.
2. It doesn't matter how appreciative you are. You are NOT allowed to use the artist's original work without permission in the first place. Keeping that original work in there makes it not applicable for fair use.
3. I don't think you getting it. "Not subtracting from the original work" doesn't make it okay, it makes it even worse! The colors you added would be nothing without the original work, which you do not have the permission to use. You have not created your own unique work by adding colors, you have enhanced the original work. Which you did not have permission to use in the first place.
4. Oh, are you an economist now? They may have not changed the price of manga, but that doesn't mean nothing is going on. The article I linked you, if you actually read it, says for a fact that manga sales have decreased as more images of their publishments have been circulated on the internet. When a person buys a book, they own it. They may re-sell it, but they are not permitted to copy any of the information contained in the book.
Yes. Yes they are being pirated even if they are not being sold. It doesn't matter what country the manga is bought from. JAPANESE MANGA PUBLISHERS are also on the hunt for these sites. Did you not read the artical?
Reading the manga online violates their copyright which says that they cannot distribute copies what is inside the book, and it hurts sale. Why buy it when it's online?
I'm sorry, education is not the catch all. Anything can be 'education', but what this means is a teacher in a classroom setting using it with academics.

Go read your dictionary again. To educate is a means of learning or gaining knowing of something. You do not need fancy degrees to educate someone. You do not need to be a teacher or have academics be the only reason to educate someone.
Yes, I did read that article. Scanlations and fan coloring seem a bit irrelevant to use against me to say I'm breaking so laws. Is that why youtube and other people who make anime music videos can use the Fair Use act and I can not?
Oh, are you an economist and a legal expect now who goes to art school arguing with an 18 year old who enjoys as just as much as you do; also who had no intention of arguing?
Making rude remarks makes you an expect and have seniority over me? You keep going on with your words sounding like oppnions.

I know the dictionary meaning of educate. This doesn't mean it's the same under law. It's meant to protect teachers of government funded classrooms from having to hassle with permissions so they can educate their kids. It's not meant for everyone else to abuse.
Scanlations are illegal. You have colored an image that is illegal in nature in the first place. Distributing these colors is the same as distributing scans, as they contain the original work. They give images out that are only meant to be sold in books.
Haha. AMVs are taken down all the time. They are not under fair use, there's just so many of them it's only a small dent.
No I'm not. I'm saying the article has experts who say that manga is hurting because of scans.
I'm making rude remarks because you are pissing me off.

They are illegal to an extent, commercially licensed series are usually put to a stop with legal actions. I know this, I'm not being stubborn. Onemanga has many series they removed because they are licensed. Even quotes from the sales representatives benefit from scanlations. They use them to find out what series should be licensed by popularity. Even scanlators encourage purchase when a manga is licensed in english translation.

misnina In reply to Taiyouhana [2010-07-21 09:41:56 +0000 UTC]
Just because they encourage it doesn't mean it wasn't illegal in the first place. All of them are commercially licensed, it just that scanaltions were ORIGINALLY just about localizing it until it got an English release. It was illegal, but looked over as it did help to see what people liked.
Originally.
It's not like that anymore. There are so many sites that ignore when a series is published in English, and may even scan the English release itself.
But at the end of it all, scanaltions were illegal from day one. They do not have the permission to distribute these images. So why are you allowed to make edits to these images that are illegal to distribute in the first place?

Taiyouhana In reply to misnina [2010-07-21 09:50:08 +0000 UTC]
I'm not disagreeing with you that it is illegal.
My scans were in Japanese to begin with, so how am I to blame? I took scans and enhanced the lines and added color, some I add text to so it has some dramatic or comedy effect. I'm not make these edits for anyone but myself as a fan. I'm not making them to show off what I have. I upload them to show my ability to color a scan that isn't offensive at all.

Your scans were in Japanese. Yes, and? They are images copied from a book that does not allow you to copy them. You can't use them.
I did not say your images were offensive. It doesn't matter, they could be the most lovely colorings alive! But you still don't have permission to use the image you colored. It doesn't matter why you are doing it, you don't have the right to manipulate those images.

If you purchased a japanese manga, you have every right to color on ir with crayon or with photoshop. Coloring and editing something that you paid for doesnt make it illegal. Thousands of DJs would be arrested for making remixes of songs if that were true, yet theyre allowed to upload their music onto itunes as a podcast free for download?

misnina In reply to Taiyouhana [2010-07-21 10:09:01 +0000 UTC]
Yep. But you are not allowed to copy the pages on to a computer. You may show these colored images, but you are not allowed to make a copy of them to distribute on the web.

Taiyouhana In reply to misnina [2010-07-21 10:16:12 +0000 UTC]
Making a digital copy for yourself saved on your computer when you bought the original isn't illegal. :/ Jeeze man, I'm looking all this stuff up you say and most of isn't even true.
Honestly I do not care if you have a problem with me uploading pages I color. If you do not like it then, report me. I don't really care. You can whine about as long as you want, I don't care if if it falls under fair use or not. Go ahead and see what happens when you report me.

"I am claiming NO ownership."
Fair use says~
"Acknowledging the source of the copyrighted material does not substitute for obtaining permission. "

"When it is impracticable to obtain permission, use of copyrighted material should be avoided unless the doctrine of fair use would clearly apply to the situation."
Should I email the creator or Bleach and Naruto, or would you like to? The Fair Use relates to this.

It is impractical that they would reply or give you permission, so it says you should avoid using it.
But by all means, ask for Tite Kubo's or Masashi Kishimoto's written permission.

Taiyouhana In reply to misnina [2010-07-21 09:14:00 +0000 UTC]
Or when a Fair Use statement bypasses that.
I'm using a SMALL part of the artists work. One panel or page. The public is allowed to use when not claiming ownership or publishing.
π: 0 β©: 1
misnina In reply to Taiyouhana [2010-07-21 09:24:53 +0000 UTC]
Which it clearly doesn't. So it's best you not use it, or obtain permission.
One panel is still the artist work. He put work into that ittybitty panel and you have no right to use it!
NO. NO. NONONONO.
The public is not allowed to use when they don't claim ownership!! Why do you people think this?!
"Acknowledging the source of the copyrighted material does not substitute for obtaining permission.'!!
It's not yours, don't use it! End of story! It makes life much simpler!

How doesn't it? I'm sitting here reading off reasons in my support while you're telling me I'm wrong.
I'm not stealing or copying an artists work. Im using an artists work as a base to show something different.
I'm not using another artists work to gain anything.
By saying I'm not claiming ownership is not me claiming it is mine in anyway. I'm not lying or fighting for anything. I'm using an artists work under fair use.
Same with quoting from a book. The more you take the the less it becomes reasonable to use. Using a page or a panel out of hundreds of pages that have been made is not me using it as my own!
I'm not taking work that has not already been published and trying to steal from an artists success.

misnina In reply to Taiyouhana [2010-07-21 09:53:43 +0000 UTC]
It does not matter how you are or are not, or not gaining anything by using the art. You have no permission to do so. It doesn't matter if you are not lying or fighting for anything, you are not allowed to use these images.
You are not taking work that had not already been published. You are taking work that has already been published, which the publishers state that you are not allowed to use.
It doesn't matter that you are not using these images as you own, you are using them. Period. When you are not allowed to use them.
If I draw a manga, you are not allowed to use any of those images because I'm the one who created that image.
If a teacher in a classroom wants to talk about manga, they are allowed to use the image. If a person want to report news about my manga or manga in general, they can use an image accompanying it. If someone wants to do a parady of my manga, they may not use that image but they may mimic the original content to make fun of it. If a court hearing has to use my art, they may. If it happens to show up in a newsreel, that is allowed.
That is what all of those conditions says about fair use. In no way does it say that someone is allowed to manipulate my images and distribute them.

This man took an entire anime series an made a parody while using the orignal scenes from the anime. His videos can be found on even itunes for free download. What you just said would make this make be in trouble, yet he's been recognized by Shonen Jump Magazine, and by the American translation company, 4KIDs.
Unless I ask you to use your unpublished work, then I can't use it legally. If you publish your work, then you do lose some rights you had to that work. Same as how when a series is made into english, the enlgish publisher has rights to alter and censer parts. It's up to the publisher also.
