I tell this to every person I see uploading art that is not their own, so I'm not specifically targeting/bullying you or anything.
They are against the rules, it's just that not everybody catches everything, especially since this site is so huge and has tons of stuff uploaded every day.

I guess. I just don't see how what I did was against the rules yet every other form of art is okay. I didn't copy the image. I changed it. I didn't claim it was mine and I never made a profit. Even your drawing of Emo Totodile technically breaks a trademark law. You are using Totodiles likeness by drawing him. The creators of that character can ask you to remove that because you don't have the rights to use it.
I'll shut up about it though it's done. Sorry for causing such trouble.

I am not making any money, it is fanart, fanart is not illegal. BUT, yes, if nintendo suddenly decided to remove all fanart ever, then yes, it would have to be deleted. Technically any company can get any fanart removed at any time if they wish, but most don't.

If I am hearing it right. It basically states that your image of Totodile is Copyright and also that nearly every drawing of any non-original character is copyright. My image was just as much copyright as yours is.
Don't get me wrong here. I'm not trying to deny mine being copyright. I don't own it and I'm using it. I'm not following the laws as I should. My only issue is that others are doing the same thing(The entire site is built on it) just in slightly different ways.
You could get in trouble for your image just as much as I could with mine. Neither of us are making money or did make money and neither of use are claiming to own the characters or images used to create the artwork we posted.

The big difference is that I drew it myself, while you took and altered somebody elses image.
Fanart that you drew yourself of a trademarked/copyrighted character is not illegal, and does not require permission, but they can still be removed if the company decides to crack down on fanart. So yes, Nintendo can take down my image if they don't like it.
Fanart drawn by you not for profit= okay
It is okay to draw a fanart of a copyrighted character for non-profit.
It is not okay to alter an image that somebody else owns.

I still feel that since you Drew someone elses character it's just as bad.

There is no point to keep going on about it I guess. We both have our opinions. I just feel we do something equally as bad as the other. Neither of us is protected under copyright laws for different reasons. I just feel deviant art itself should change the rules to be universal over all art forms and not just some.

Fanart= what I did= creating an original image from scratch(I own the image itself, but I do not own the character)= okay, but technically can be removed by Nintendo if they wanted.
Stealing= what you did= taking art that you did not own or create and altering/copying/tracing it= not okay, because the art you altered was not yours in the first place.
The difference is that I own the actual art, you do not own anything.
Deviantart shouldn't change the rules, because what we are doing is not the same.
If you are still not getting the difference between what we are doing after this post, then I don't know what else to tell you. Copyright isn't that hard to get and you are trying to make it more complicated than it is.

I had not idea that it would blow up like that, I just posted it last night with no thought and woke up to see it's popularity. I know that DA is only for art, not screen shots but I don't usually get views on my pictures so I just assumed this it would be unnoticed. I know a lot of people work so hard to get their art to the front page, I'm one of them so I'm truly sorry.
