She doesn't have to change a thing -- you do not own tails, nor are you the first person to use that design. Blur out your name with photoshop, I'd love to see proof of your claim.
Even if you did, that's only copyrighting your work. It does not cover the actual design, as you cannot copyright colors, patterns, or textures.
