Actually, according by the law, you are. Generally, every time something is created, a basic copyright is laid over it. Since dA gives you a copyright over any deviation you submit, they are giving you rights over something already protected. That is clear about your latest poster, using an image of a band, which is obviously copyrighted to them. You are obviously not going to be sued by any of these images' owners, but if they wanted, they could.
This is part of the little I know about copyright, but what I do know about dA's rules is that, if you don't have the owner's permission, save a few cases ([link] - last paragraph), you can't submit/use it.
