at first they never had a warning about using it, so I used it, and credited them, but after that they started posting other deviations saying do not make a base, I never used his artwork again to make bases. but I think this base was made two years ago, and I think they let it slide, but I know not to use their artwork.

I know, I was still a newbie, but now I ask people to use their artwork. If they have a button on their deviation saying "you can use my art artwork"  i'll use it. If they don't, I ask.
