yah but the trick they use is that they make it unrecognizable. If a few people can tell it's from 2012 then you'll get in trouble for copyright...otherwise it's a beautiful bg.
There is one thing you can do...you can give credit to the movie and mention that it's a photo manipulation. But the contests usually don't even allow that much.
If i were u i'd just use it as a reference and make my own. like keep the whole thing in mind but draw another part of a continent going down like that. or copy past your own pics on the sliding so that it's not the exact part of the planet going down as 2012.
There are also artists on here who allow you to use their photographed backgrounds and characters and poses. look for them.

no im not so talented ^^ i just used a simple bg and worked on it..combinate some things on photoshop and so on ^^
it took 1 1/2 hour.

This background picture was definitely taken from a scene in the new 2012 movie, you have to give direct credit where it is due and tell your audience clearly in your artist comment where you got that. Not doing so is very thoughtless; think, a team of people worked very hard to produce that.
