I'm now scared of saying anything about Poison, because I'm scared that I could offend the transgendered community on DA. I already unwittingly offended one of them by commenting on a Poison pic.

Depends on what you say about them, but only a fool is offended when offence was unintended.

Beside that, there were never jokes about her being a transvestite.
The character designer laughs when he is asked and says you are free to pick what she is, but he inisitally meant for her to be a regular woman =bullshit

That video was educational. I learned quite a bit, and can see both sides to it. There is still official evidence made to make it questionable. It really isn't that important, but here are points you can add to that list.
-According to Staff (March 2007) "The Making of Final Fight", that is where the story comes from where they changed the gender for USA to avoid getting sued on beating women, also supported in "All About Capcom Head to Head Fighting Games" (ALL ABOUT γ«γγ³γ³ε―Ύζ¦ζ Όιγ²γΌγ ), an official manual to Capcom.
-Also in "All About Capcom Head to Head Fighting Games", it states on page 339 that the characters were originally planned to be normal females, but during production they changed it.
-Akira Nishitani stated when specifically asked if Poison was a man, he said, "I suppose the character could be male, but added it is up to the viewer to decide."
-In the international comicon 2011, Christian Svenson said "Poison's gender is intended to be ambiguous." seeing as she acts like a tomboy.
-A later appearance by Poison as playable character in Final Fight Revenge, an American-produced 3D fighting game spinoff of Final Fight, portrayed the character in an overly feminine manner and had her romantically interested in Final Fight hero Cody. Commentary about her ending in the game in "All About Capcom" suggested that the character might have gotten a sex change.
-Poison is officially a female in the english edition of Final Fight Revenge. This is a situation where Capcom Japan did not tell Capcom USA what was going on. It is argueably official and not at the same time.
-When the games have been advanced enough to recived interaction between characters, she is refered to a woman, but I suppose looks can be deceiving.
-It is awfully hard to conceal her manly bits in those short-shorts, but I suppose it is possible.
-the japanese term used as "newhalf" (γγ₯γΌγγΌγ) does not actually mean transvestite. It has a number of meanings, which include hermaphrodite, but also androgynous or homosexual. This is a poor point though, because they placed that under gender.
thinking... thinking... I got nothing else right now... XD There will forever be people on both sides of the debate, and capcom seems to love the attention from it, so they leave it pretty open. But I say she is a woman simply because I do not want to admit being attracted to a "newhalf" XD
