You have to have pickpocketing up to the poison skill. Just use the paralysis poison on him and pickpocket his hat from him before he stands up. When he stands up he will act as if he were about to attack you, but does nothing.

jester hat has 0 armor) try to find the Diadem of the Savant near Froki's Shack on a wood chopping block ([link] ) it has some armor so he'll wear it instead of his hat)

well this is a whole story) i was annoyed by his hat so first i enchanted a circlet for him but it wasn't enough cause i wanted to see him without anything on his head) so i decided to download NPC Editor (here it is [link] ) and i just changed his clothes in there. just choose some random clothes without hat for him
