You don't have the copyright to this image. You copied someone else's photo and that photo was a replica of character's you didn't design. I know you worked hard on it but it doesn't give you legal ownership of anything. Rather you are the one infringing on Lucasfilm's copyrights, the photographer's copyrights and maybe the designers, Ralph McQuarrie and Norman Reynolds, rights as well. The only reason no one cares is because you are promoting the franchise, but they might start caring if you start selling posters. Count yourself warned.

Well... that's why there's a "fan art subfolder" and a "traditional art subfolder" on Deviantart... Did you write this below every other drawing of the same reference, because there are many out there (especially those who don't mention references at all)? Drawing fan art is not illegal as long as people don't trace, by the way.
I have to put a watermark on my drawings and write something in the description, because otherwise everyone would just copy and sell it (ok... people try to sell my stuff anyways or to promote themself). I just share my drawings for fun on dA (and I choose reference I like for practicing; metall in this case).
Who said I want to sell posters? Selling fan art is illegal if you have no license. That's a mean allegation.

Mean allegation? No. I didn't say you were selling anything. No allegations. And I don't mean to be mean in any way. I'm sorry if it came off that way.
You are not correct about "as long as it's not traced". If you were brought into court, and again as long as you're not making money on this you might be safe, if you were brought into court you would have to show that you didn't use the intellectual property of someone else. If people can recognize the characters in your art as something that was designed by someone else then... It's theirs not yours. You may have worked hard on it. That doesn't mater. And even if you added a ton of your own innovations into the image, like C3PO is dressed in a top hat and riding a horse...it still has someone else's art imbedded in it. They would argue that it was their creativity and the hard job of marketing it and the money invested in it that made your image successful. If not then why did you use their art? Why not make your own metallic man? Do you see?
Now there's nothing wrong with being inspired by someone else's work. C3PO has a lot of Art Deco elements, what would he look like if he was based on Art Nouveau? and gold and mat black or metallic red? C3PO is just one possibility. Maybe you want a gold android but why not make it a woman orΒ a child or a dog? If you do this you are being inspired by but making your own art. People will not justΒ look at it as a successful copy but showing your own choices, your design, the result of lots of sketches and thinking. You're not an output device!

No worries. I just sounded a bit "aggressive" to me (could also be a language problem/misunderstanding?).
I get your points and agree with you on some of them (fan art is not 100% legal, but it still exists), but I don't want to create my own art (I'm no artist! I draw like a "photocopier", because it's fun for me) unless I want to draw one of my photos for example carnivorous plants, self-portrait, Australia. If I use pictures from other people I even ask for permission or take a look at their conditions if it's possible. And for fan art: I don't say that I created the character. That's why I list references. I just say that I created the drawing. The copyright stuff is a bit complicated and there's a gray area (promotion for the company, if you don't make profit with it and so on... I don't know how to explain that in English...). I want to draw fan art, because I like movies, games or whatever and to pay homage to them not to steal anything. I'm still going to draw it, because I want to like anybody else (but I don't need to upload it on the internet, by the way... So everything I did when I was a child was illegal? Sounds funny and as I said: gray area). I probably won't reply to the next comment, because I have way too many comments to answer and my drawing mood is also not the best since a few weeks (Thanks...).
So do you want to contact the deviantart staff now and tell them to remove that illegal dA fan art folder? Good luck.
By the way: I'm one of the few people who think about getting licenses to sell fan art (e.g. Marvel), so you're definitely talking to the wrong person. I'm one of the 0,001% on the internet with pricks of conscience (and I also don't hide behind a fake name).
