I like this one better. The other one made me think a woman, or a cow was holding her breast (or udder) and just aiming at the glass.

Not...really... seeing an idea and trying it out for yourself isn't really theft. Taking the picture from someone else's account and claiming it as your own? That's theft.
Besides, stuff like this gets done in photography all the time. I mean, how many people take pictures of flowers in a sunset? Doesn't mean they're stealing it.

Well, it is very similar, but It's not theft since this and that one you're showing are very different pictures. This could have been either totally original (Him being not aware of the picture you're pointing out.) or inspired by that one. Either way, he worked to make this shot work and that's what makes it his truly. :]
