Yes, Herons do sometimes sit in trees!!
I definitely don't follow the rule of thirds with this image but I had to put it on here (because these are birds you usually would find wading through water)! 
As usual, this photo was taken with a FujiFilm FinePix HS20 EXR Please don't use this without my permission... Thanks!

What a wonderful shot!!! I remember a heron that would sit on chimneys when it was cold if he seen smoke coming out. He learned it was warmer air. But I have to laugh, he expression looks like he is seriously trying to remember something!
