And in reality, that's the ONLY way Khan would know that Kirk and Spock were talking to each other in code.

And to be honest, there are tonnes of problems with that video.  More so criticizing Khan not knowing Kirk and Spock were speaking in code.  But here's the thing, WE ONLY know that they were speaking in code AFTER watching the movie and the scene over a hundred times, on chat rooms, message boards, etc.


Let's look at the script:

KIRK: Kirk to Enterprise.
SPOCK (on intercom): Spock here.
KIRK: Captain Spock, damage report.
SPOCK (on intercom): Admiral, if we go by the book, like Lieutenant Saavik, hours could seem like days.
KIRK: I read you, Captain. Let's have it.
SPOCK (on intercom): The situation is grave, Admiral. We won't have main power for six days. Auxiliary power has temporarily failed. Restoration may be possible in two days, ...by the book, Admiral
KIRK: Meaning you can't even beam us back?
SPOCK (on intercom): Not at present.


Ok, where was the clue?  Hm?


When Spock said, "if we go by the book, like Lieutenant Saavik."  First, Khan doesn't know Saavik who is very well known for quoting regulations.


When Spock said, "hours could seem like days."  That sounded more like the Enterprise was more seriously damaged than anyone thought, and not someone saying outright, "ADMIRAL KIRK, I'M SPEAKING IN CODE JUST IN CASE KHAN IS LISTENING!!!!"


There is also the fact that Kirk and Spock knew each other, and knowing Saavik quoting regulations and knowing Regulation 46A -- "If transmissions are being monitored during battle, no uncoded messages on an open channel."


Kirk and Spock were not 100% sure they were being monitored, BUT it is a wise course of action in a situation like that like, "Queen to queen's level three; Queen to king's level one," or, "Condition Green, all's well. Kirk out."  And Scotty reports, "But they have used the code term Condition Green, which means they're in trouble."


Back on topic, both Khan and Saavik were fooled.  And when first watching, so were we.  When we first heard Spock say they wouldn't have main power for 6 days, WE thought he meant 6 days.  When he said restoration may be possible in 2 days, WE thought -- like Khan and Saavik -- he meant 2 days, not hours.


We only clued in after we REWATCHED the scene.  We had more clues that Gabriel Lorca was from the mirror universe, and we had assistance from chat rooms, message boards, rumours, even reports -- official or otherwise -- stating that Discovery would feature the mirror universe.


So the only way for Khan to have clued into Kirk and Spock's deception was to watch one of those instant cassettes from Spaceballs (1987), right along with The Producers (1967), The Twelve Chairs (1970), Blazing Saddles (1974), Young Frankenstein (1974), and Silent Movie (1976).


As stated, WE only know because of multiple viewings.  Neither Khan nor Joachim had an instant cassette of Star Trek 2: The Wrath of Khan (1982) to rewatch that scene, it was always a live feed and the clue didn't pop up right away even for the "superior intellect."


It's like this post over a certain criticism over Star Trek 2: The Wrath of Khan (1982):

And the video forgot the most obvious problems with The Wrath of Khan.  Khan knowing Chekov, and the Enterprise able to reach Regula 1 without warp drive.
